These Terms of Service (the “Terms”) govern your access to and use of the Traither mobile application and related services (the “App” or “Service”). The App is provided by LJ Digital Solutions UG (haftungsbeschränkt) (“Traither”, “we”, “us”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Traither is a fitness training-partner app that helps users discover, connect, and arrange to train with one another, create and join training sessions, join communities, and exchange messages. Traither only provides a platform to connect users; we do not organise, supervise, or participate in any training, meeting, or activity, and we are not a party to any arrangement you make with other users.

2. Eligibility

You must be at least 18 years old to use the App, because the App enables users to meet in person. By using the App you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. We may suspend or delete any account where we reasonably believe the user is under 18.

3. Your account

• You must provide accurate information when registering and keep it up to date.

• You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

• You may not impersonate any person, create an account on behalf of someone else without authorisation, or maintain more than one account in a deceptive or abusive manner.

• Notify us at info@traither.com if you suspect any unauthorised use of your account.

4. User content

The App lets you create and share content, including your profile, photos, bio, sports and preferences, communities, training sessions, and chat messages (“User Content”). You retain ownership of your User Content. By posting it, you grant Traither a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your User Content solely for the purpose of operating and providing the Service. This licence ends when you delete the relevant content or your account, except for content already shared with others or copies retained as required by law.

You are solely responsible for your User Content and confirm that you have the rights necessary to share it and that it does not infringe the rights of others or violate any law or these Terms.

5. Acceptable use and zero-tolerance policy

Traither has zero tolerance for objectionable content or abusive behaviour. When using the App, you must not:

• post or share content that is unlawful, harassing, threatening, hateful, defamatory, sexually explicit, pornographic, violent, or otherwise objectionable;

• harass, bully, stalk, intimidate, abuse, or threaten any other person, on or off the platform;

• post nudity or sexually explicit material, or use the App for prostitution, escort, or any sexual service;

• discriminate against or promote hatred toward others on the basis of race, ethnicity, national origin, religion, disability, gender, age, sexual orientation, or gender identity;

• post content involving or directed at minors, or attempt to contact, solicit, or meet a minor;

• impersonate others, post false information, spam, advertise, or solicit users for unrelated commercial purposes;

• share another person's private or personal information without their consent;

• upload viruses or malicious code, or attempt to hack, disrupt, reverse-engineer, scrape, or gain unauthorised access to the Service;

• use the App for any illegal activity or in violation of any applicable law.

There is no tolerance for objectionable content or abusive users. We may remove any content and suspend or terminate any account that violates this policy, at our discretion and without notice.

6. Reporting, blocking, and moderation

You can report objectionable content or abusive behaviour, and block other users, directly within the App. We review reports of objectionable content and act on them — including removing content and ejecting the user who provided it — within 24 hours where appropriate. Blocking a user prevents further interaction with them. We may use both automated and manual moderation to enforce these Terms, but we do not guarantee that all objectionable content will be detected or removed. 7. Safety and meeting other users

Traither helps you connect with other people and may lead to in-person meetings. You are solely responsible for your interactions with other users. We do not conduct criminal background checks or otherwise verify the identity, statements, or conduct of users. We have no control over, and are not responsible for, the actions of any user on or off the App. Please use good judgement: meet in public places, tell someone where you are going, and stop any interaction that makes you uncomfortable. You participate in any training, sport, or activity arranged through the App at your own risk, and you are responsible for assessing your own fitness and health to do so.

8. Subscriptions and purchases

The App may offer optional paid features or subscriptions. Where it does, prices and terms are shown to you before purchase, and payment is processed by the relevant app store (Apple App Store or Google Play) under their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel them in your app store account settings. Except where required by law, payments are non-refundable; refund requests for app-store purchases are handled by the respective store.

9. Intellectual property

The App, including its software, design, logos, and trademarks (but excluding User Content), is owned by Traither or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable licence to use the App for your personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.

10. Termination

You may stop using the App and delete your account at any time from within the App. We may suspend or terminate your access, with or without notice, if you breach these Terms, create risk or legal exposure for us, or if we discontinue the Service. Upon termination, your right to use the App ends immediately. Provisions that by their nature should survive termination (including content licences already granted to other users, disclaimers, and limitations of liability) will survive.

11. Disclaimers

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, secure, or error-free, or that any content provided by users is accurate or reliable.

12. Limitation of liability

To the extent permitted by applicable law, Traither is liable without limitation only for damages caused intentionally or by gross negligence, and for injury to life, body, or health. For the breach of essential contractual obligations (obligations whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely) caused by slight negligence, our liability is limited to the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded. The above limitations do not affect liability under the German Product Liability Act (Produkthaftungsgesetz) or any other mandatory statutory liability. In particular, we are not liable for the conduct of other users or for any loss or harm arising from your interactions or meetings with other users, except where such liability is mandatory under applicable law.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold Traither harmless from any third-party claims, damages, and costs (including reasonable legal fees) arising from your User Content, your use of the App, your interactions with other users, or your breach of these Terms or of any law.

14. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above and, where the changes are material, notify you in the App. Your continued use of the App after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App and may delete your account.

15. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.

16. Apple App Store

If you download the App from the Apple App Store, you acknowledge that these Terms are between you and Traither only, not with Apple, and that Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Maintenance, support, and any warranty claims are the responsibility of Traither and not Apple.
